Hacking i cant update to the latest version?

Wait you don't see your Emunand at all? Are you sure you're booting in to your emunand then?
here whats happening. when the SD card is present im booting to my old emunand. when the SD card is absent im booting on diff nand which i can tell because it has no themes. but my folder on my emunand is present there. how can i verify that the nand which im booting without SD card is CFW?

The systen wont have a theme if the sd card is out :| the data is on the sd card. Just hold select while your sd card is in and deselct autoboot emunand so it doesnt do that. You also might want to plug the sd card into your pc and back it up so you can get rid of the emunand after you get it working so that random emunand isnt taking up space. (Unless you already did this)

hmm how will i delete the previous emunand on my SD? and what do you think is the problem why i cant update?
 
Did you modify your home menu? Usually the inability to update is caused by modified home menu. You'll have to install clean home menu and try to update. If you want to move your EmuNAND to SysNAND, then follow the proper section of the Guide.
what do you mean modifying home menu? like changing its icon sizes? and also i followed this guide and im stuck in this section.

You have to boot godmode9 through B9S.
If godmode9 doesnt have that area, then you dont have an emunand.

hmm i booted on godmode and dont have that option. so since i dont have emunand i think is it because i came from A9 right? so the remaining problem is the update which still gives me error.
 
Please stop bumping your thread, it doesn't have priority over the other ones here; people will answer when they can/choose to.

Anyway, make sure your DNS setting are set to "auto", install a fresh version of the HomeMenu just to be safe (No, it won't cause an issue), delete all your internet configs in "system settings" , set them up again and then retry the update.

If that doesn't work (please actually DO the steps, don't just read them assume they won't work and refuse to try) try to update through recovery mode.

Back to the topic, have you edited the homemenu in any way? Like changing the font, changing color or text, or anything of the sort? What luma update are you on? 8.0? 8.1? 8.1.1?
The only thing I could think of would to backup your nand, perform a ctrnand transfer to 9.2 and see if you can update from that if we cant figure out whats wrong.

if editing means changing themes and changing icon size then yes. but if it needs modification then no. im using the latest 8.1.1.

after trying what Majickhat55 recommended i will try your suggestion. again im really sorry guys.

No editing means like changing fonts, the Sleep display texts, editing other text, etc. Editing the HomeMenu requires extraction etc. you'd 100% know if you did it or not. My best guess is your internet/router settings.

ow i didn't change any on my home menu. and also i have 2 Old regular 3ds and the other one updated just fine. their only difference is my other 3ds comes from system version 11.1 which updated just fine to 11.5. but my other 3ds firmware is 10.4 which got the problem.

Yeah just do what I said. Have you checked the DNS settings and set them to auto?

Hold A+L+R+Up before turning on the console to boot into recovery mode and try to update from there.

finally solve the problem. i just did a ctrnand trans of 9.2 firmware. thank you so much for you help. and last question, since i fresh install a new firmware how am i going to install FBI? because im only familiar on A9 method which i extract the H&S app then inject the FBI.
