Can't you just erase it?
Also you can't do system transfer. Unless you did a hardware mod.

And Duo8, oh right, so this is sort of pointless? or is this a way to keep my firmware and still be able to play Pokemon Y?

Look, if you're after Poke Y, best just update.

As of now the emuNand system has one huge flaw, its method of compatibility with games like Poke Y is that the save file is linked to your emuNand meaning that there is a risk of losing your Poke Y save data in the future depending on how emuNand progresses.

I myself recently got a 4.5 XL and updated it for a system transfer from my previous 3ds so that everything will work fine. I'll just hold out for 6.3 exploit if it comes at all. Just get the usual few games, its not like you'll be playing every single game in existence.
