Nope. Libnx requires higher privileges. Running it on non modified Switch will result in game crash/system crash/hanging system. Plus not using official SDK opens vulnerabilities. That's why Nintendo will never accept it.

No, but you can check that without source code.
Just open game in any dev unit and debug nn services.
