But it's possible for Nintendo to check the console whenever it connects to their servers.
Therefore it's a risk wich could be avoided.

The previous bans, yes.

But again: No one can tell what Nintendo will do when XS OS is out and piracy wide spread.

Telling everybody that it's safe to use XS OS online (to download updates) is just wrong.
If one want's to take the risk, okay. But don't advise others to do so.

Some more advice should i update to 5.1.0 from 4.1.0?
