Homebrew Firmware spoof oh hans in oras

Hey!
I want to battle on the battle spot in oras without updating the firmware of my N3DS. But as far as i know, you need the latest game update and firmware to use internet in the game.
Is there any way to join the internet without updating the system? Does it work with the firmware spoof of hans? I know that Pokémon banned some persons, so I want to ask before i try it for myself.

I think it's possible with the newest version of AuReinand, but you'd need to have CFW for that.
