Famicom Classic has been hacked

Now this is called abuse. We have plenty of resources (Emulators, the Wii, Wii U, 3DS) to play past experiences, if any related to piracy is done with this starting hack I'll call it plan abuse.
 
So why is Nintendo legally obligated to share the source files for the emulator used in the NES Classic? That confuses me.

According to the article, they're not. They're obligated to provide the source for the Linux kernel it's running on. Linux is GPL.

Probably cause they aren't using their own software/hardware but open source content while supplying their games/roms. Not sure how important it is, but this is better spent on a better emulation system if you don't want to limit yourself to just 30 games. :P
