I believe the dpg format uses mpeg1. Every game on the DS seems to use ActImagine Codec which is part of the DS SDK. Why isn't there an encoder for this format available?

Nintendo does not hold the copyright to the codec, but they do license it for their SDK. So the answer is that it's comprised of proprietary code that they license only to prominent companies like Nintendo and some cell phone manufacturers, and that's why you can't get it.
