How would I check to see if I am banned on my 3ds without risking to get banned? That might sound stupid but I need help with it

Go to your friends list and connect online, if you get an error, you're banned, if not, then you're not banned.

If you have CFW and you don't want to get banned, it is recommended that you turn off the Spotpass "share information" setting, and it's also recommended that you turn off the Friends List "show what I'm playing" setting. To be safe, I turned off the "show that I'm online" setting in the Friends List.

Why should I turn off spotpass? Does it stop a trigger in the ban system or what?
No one is quite sure if it does or doesn't. All I know is that all my systems that were offline weren't banned and they still haven't been banned with spotpass turned off. My Goat system that I left Spotpass on was banned (I later unbanned myself) and has yet to be banned with spotpass turned off.
Spotpass does send information from your system to Nintendo, so honestly it's just worth turning off for that reason alone.

Can you walk me trough how to turn that stuff off? Sorry if I am annoying

First, go into your System Settings. Go to Internet Settings. Go to Spotpass. Turn off Automatic Software Downloads and turn off Sending of System Information.

Second, go to your Friend List (orange smiley face at the top of the home menu). Click Settings. Click Friend Notification Settings. Turn "Show friends what you're playing" to No. Optionally, turn "Allow friends to see your online status" to No, but you probably don't have to do that. "Show friends what you're playing" set to No should suffice.

Method 1 should keep you unbanned indefinitely if you changed your settings to what I said on both 3DS systems.
Method 3 is your next best option, but your 3DS will probably be re-banned in a matter of days or weeks if the LFCS_B is public. You will have to repeat Method 3 each time you're re-banned.

If you can get ahold of a private LFCS_B (not shared online to anyone else), then that's as good as having a second 3DS, and you can follow Method 1. If you do not have a private LFCS_B because you don't have another 3DS, then you need to do Method 3. However, because the seed will be public, Method 3 is only temporary, and eventually you will have to repeat the process when that public LFCS_B is banned.

How would I get one? Also wouldnt method 2 work?

You will keep your Friend Code and friends with all three methods.

I should also note that the 3DS is a dying handheld anyway. Nintendo has almost no first-party titles left for it, it has been succeeded by the Nintendo Switch, and they will likely end online play for everybody's 3DS in the next 1-2 years.
