    Again, for the final time. A ToS does not matter. A company (read: any company) can put in their ToS whatever they want. That does not mean that a ToS is the 'law'. Many big firms do this indeed. (Think of Google, Facebook and so on) So I know exactly what you mean.

    If your from the US, nothing for you. But your question in general. It would be interesting to see what data Nintendo keeps under people's profile. Then take the necessary steps to somehow get some access back to updates. (FW & Game) But this is just a pilot to see how it goes. Not guarantees.

    You might be right, but if you look on the back of the game package (cart) it is sold/licensed by the german GmbH of Nintendo. So EU citizens have to deal with the European branch of Nintendo.
