If you're not running a CFW, FBI will return an error if you try it. Any CIA installer will do the same, not just FBI.

Pretty much yeah. But you can currently downgrade to 9.2 from the latest firmware.

If you're on 10.5 or less, don't upgrade though as it will make downgrading more difficult.
