    This would definitely be used for the anti-piracy system of 3DS. If you would use it as a pedometer, you need to open it or leave it in sleep mode. Isn't it advertise that 3DS which are at close range will sync with each other sharing data etc. etc.? then if the other 3DS has the latest firmware...
