IIRC, Ninty actually tried to give him an off-ramp instead of going for the nuclear option straight away. They first tried with multiple cease and desists and he supposedly even agreed to it, but he still persisted anyway. -

To be fair, this guy is a total muppet. Trying to make a profit distributing pirated material, particularly Nintendo games, is a stupid idea. And then he bloody ghosts the court. He was asking for it.
