that's on competitiv games like Splatoon or whatever, they have made a better protection though Save Transfering/Editing, i think for little games like Kirby there is no chance or very low chance of result on a Ban

As I said before, when the time comes they will be banned.
Modifying any online game (whether through different saves or cheats), as in any game where you actually play with others online through matchmaking, no matter if through NSO or not, poses as a thread to being unbanned, competitive ones might get you banned directly because as you said they pay more attention to them, however the process will flag your console regardless and in the next wave you'll probably get hit, I have seen so many people that got banned "randomly" at some point after doing something bad a longer time ago.
Havent played the new Kirby yet but since it is a Nintendo title, I wouldnt try my luck.

try to launch it in Offline (Flight Mode) and do a Solo Game to increase your Exp, then you can quit when it have save, then try reload Online

so I did exactly that :

I'm using JKSV ver 09.01.2021, I select your "100Kirby's Dream Buffet" and push restore, I play the game while in airplane mode and it still has my old rank, I play a grand prix, my rank goes up from 26 to 27, I quit the game, turn airplane mode off, I re open the game, I play a grand prix online, my rank goes up from 27 to 28... aaand that is all

Is all items included?

If you are talking about Hero Relics or Divine Weapons, yes. If you are talking generic weapons such as Sage's tome then no because they can easily be found in towns or in missions

If you want to play online in Splatoon 2, my advice to not use save from someone due to higher ban risk, but it is not issue if you are intended to use it for offline single player.
