Only using SYSNAND? how long? and are you banned yet?

TBH, Is it really a good idea to play a leaked game that early? Maybe they just know cause it's running on your system before it's actually released properly... hmm.

Nintendo's games always get leaked early, and I've always played them on emunand without issue. This time I guess I was unlucky... or foolish.

The answer is "we don't know". Some people get banned, some don't. What 100% causes a ban are piracy, installing homebrew NSPs to the Home Menu, cheating online and messing with online account stuff (custom profile pic, clearing system logs). AFAIK, custom themes and homebrew installed as NRO files to the Homebrew Menu have never resulted in a ban yet. This could change tomorrow, however, and something that is safe now might get you banned further down the line. Caution is advised.

It's weird how many people have been banned but claims that it's "not sure what bans you" when all the people I'e seen has been banned because they pirate games

yes, its the best idea, assuming your emunand is incoginto'd/exosphere'd. there is 0 risk. no one is getting banned for shenanigans in a "invisible" emunand unless its user error.

We know SOME things that get you banned, not ALL of them. Piracy is one, but simply installing an NSP forwarder for RetroArch or whatever, or using a custom profile pic, as I said, can also get you banned, even if there's no piracy involved. And to make this absolutely clear, I was banned because of piracy. I'm not pretending to be a saint who got banned for mysterious reasons that weren't my own fault. That said, you can get banned for non-piracy-related issues, and we simply cannot claim to know all of them, and neither can we be sure that Nintendo won't be adding to the list in the future.
 
Pretty sure your ISP can't undo the manual 90dns setting in your switch. That is by far the weirdest excuse I've ever heard! XD
I came to that conclusion after searching. And as it turned out, the auto acquired dns from my isp bypassed 90dns, my switch started checking for firmware updates (before it used to throw an error). Anyway, after manually specifying google's dns in my router, 90dns stso arted blocking nintendo's servers again, but it was too late. A couple days later, couldn't access eshop on my clean sysnand. Checked the error code and it was a perma ban.
 
That's pretty shitty. I'm sorry that happened to you just because some asshole network administrator decided he knows better than his customers.
Thank you. After discovering what was happening, and looking it up, found out that some ISP's dns bypasses 90dns. Had to manually input google's dns in my router for 90dns to work again. But I was too little too late by that time. A couple days later, I was banned.

they're either ignorant or ill informed, either way sad. i preach incognito/exosphere any chance i get.

I used 90dns when I got my Switch 3 years ago. And I thought it was all that is needed (so not well informed I guess) and the somehow false sense of security hold me from ever trying to research more about an alternative.

If your Switch was offline, then stay offline and uninstall Tinfoil. Crisis averted.

If it was online, or if you've gone online since, then congratulations! You've just been entered into the Ban Lottery! Will you be banned today? Tomorrow? Two years from now? Never? God only knows! The Ban Lottery never ends and you can never leave, just like some demented mixture between Mr Bones' Wild Ride and Hotel California. Except it just involves not being able to go online with a gaming console, as opposed to your soul being trapped in an endless hell.

EDIT: to clarify, you CAN go online on a banned Switch (I should know, I own one). You just can't access any Nintendo online services is all.

Nuclear Option (provided you didn’t go Online): Restore your Sysnand backup and there will be absolutely no way to see that it ever happened. You have a backup of your Sysnand, right? Right?

I did. Then I forgot to insert sd card one time before powering on and fuse was burned. I think I had a backup of 3.1? and after I had 7.x. I've asked here if I can still go back to 3.1 but never got a clear answer so I gave up.

Strangely, that includes the eShop. Big N didn't think that move through very well. I was a try-it-before-you-buy-it pirate before - that's what got me banned, I was very careless - but now that I don't even have the option of buying, I pirate 100% of my Switch games. I wonder how many people are in the same situation and how much lost revenue that represents for Nintendo.
