What a load of rubbish.
Gary did not own the sites in the first place.
Doesn't matter. Nintendo have sued him and TX for the site urls. They will get them.

EDIT: how do you know he aint the owner of said urls?

Yup. It's pretty obvious what has happened. Pretty sure they rolled on the ones they could for a lighter sentence. 99% of humans do. The 11.01 update was the bait and they took it. RIP TX ITS OVER. Lets see who has the balls to release a modchip since FW / schematics are public.

And thats why both the main site and forums are still working ........
They haven't won yet. They however will. It would surprise me if a court actually not sided with them. Same as how they own one of their older sites. Reason why there is a "-" in the team-xecuter name :P
