Buddy you’re not going to get your switch banned just for trying to see if it’s patched or not. Just do it! Your switch is in the orange zone probably because it’s not sure if it’s vulnerable to the exploit or not, nothing more.

Edit: if you come back and say it got banned only for testing an exploit out I would clearly say your talking right out of your behind! No offence intended..

A few things:

1. Merely using CFW like Atmosphere (and doing nothing else homebrew related) is unlikely to get a person banned, even if using an online feature.
2. Using an online feature and merely being connected to the internet (without 90DNS or Incognito) are largely the same thing when it comes to ban risk. A person doesn't have to play online or use the eShop, for example, to get banned.
3. All of that being said, CFW should be avoided with a clean NAND, but it alone is unlikely to get one banned. NSP files, certain homebrew applications, etc. are likely to cause bans.

If you're using pirated games or regularly running homebrew, it's recommended that you not connect to the internet with your Switch (unless you're using 90DNS and/or Incognito).
