Hacking 11.8, .cias and game updates

I'm currently on 11.6.0-39E with Luma3DS. I do occasionally install .cias with FBI and I used to update them through the eShop if the update message popped up. Obviously I can't do that any more because I need to be on 11.8 to use the eShop.

So my questions are:

  • If I update to 11.8 and use the eShop to update .cia games installed with FBI, will that still have a possibility to get my console on the ban list, or is that risk only there if you use FreeShop to download the base game off the server?
  • If there is said risk to get on the ban list for downloading game updates for .cia games, can I use Villain3DS to get the updates on my PC and then install them with FBI?
I don't really mind using Villain3DS if that's the best choice, but updating through the eShop would require less faffing around with moving files into and out of the SD card.

Sorry if this has been answered before, I searched for a while on Google, Reddit and here but most of the stuff I found was asking about FreeShop downloads - and the only post I found saying that it's safe was only one post, so I'd like to know what more people think about it.

"Type 1" games, with separate update pack (including all also-physically-released games):
- Update is a separate title
- Game is updated by (re)downloading update title
- Like any title, if you have an invalid ticket (have installed an update from any unofficial source), the update will fail to download
- Conclusion: delete any game update and its ticket, then update from eShop (including Home)

"Type 2" games, without separate update pack:
- Game is updated by (re)downloading game title
- Like any title, if you have an invalid ticket (have installed the game from any unofficial source), the updated game will fail to download
- Conclusion: delete the game (after making a save backup) and its ticket, then redownload from eShop; you don't legally own a copy? You are on your own to find an updated dump of it

An invalid ticket (for anything being downloaded) results in a failed download
No ticket (for anything being downloaded) results in a failed download, however you can obtain a license for game updates for free (indeed that's what happens when you update them directly from Home)

Any ban risk from invalid tickets is (as of today) mindless speculation, not proven by facts

I don't really mind using Villain3DS if that's the best choice
Doesn't work (see above fact about having no ticket)

Yeah, I figured as much but better safe than sorry, and all that. :B

Yeah, Type 1 and Type 2 are terms I made up (so you won't really find a list of them)

Every game also released as a physical version* must be type 1, no other alternatives since game cards are not (practically) rewritable; everything else can have exceptions

* "A game" is identified by titleID; there may be different releases of games that have the same name and play the same (like the freemium and the commercial version of Pokemon Rumble World), and these are separate games as far as the console knows

I wasn't really expecting a list. It's easy enough to look up if a game had a physical release or not, heh.

I guess I'll update and try it out with the "Type 1" games. If I get banned...Oh well. I knew the risks from the time I started using the YouTube exploit... and it's not like I play online that often, so I won't be too bothered by it in the long run.
