this is kinda illegal for nintedo to do because if you have paid for some games on your 3ds you can't redownload them untill the ban expires now allowing you to use content you paid for is illegal

My guess is that reviewers will be getting actual carts, or an eshop version with slightly different id. So there is no way they can be associated with the leaked copies (in cia form without headers) that came from dumping an actual cart.

People who actually bought the game should have some chance of appealing the ban.

My guess would be part of the NDA agreement reviewers sign to get an early copy they had to give their 3DS MAC address, or maybe Nintendo gave specific rules about what times to go online - basically something for them to cross check and see who's legit.

Have you gone through the terms and conditions that you have to accept to use the eShop? there's probably something in there that allows them to do it - so good luck trying to argue your case
