Hardware System Format and Updates.

Since formatting the 3DS requires internet connection will it automatically update the system to the latest firmware?
Ore is the collection solely for the purpose of determining whether or not the system is allowed to update?

I just got a new 3DS on firmware 9.9 , don't know if I should format it or not...

depending on FW on your system, it may ask you to connect to internet when you try to format it (unsure of the reason), but proceeding with the format will not update your system - FW will remain the same as before

You can always decline, connecting to the internet isn't required.
