Backups violate EULA. This violates the NDA. An EULA doesn't stand up in court, a NDA does.

She can if she got it from the leak and didn't sign the NDA. Alternatively she can just release it anyway cause it's hard to prosecute an nda violation If all the information you have on a person is fake.

against dah rules IIRC, you can't post copyrighted content or copyright-infringement content on gbatemp(because it was made with copyrighted tools).

It was still made with Ninty's tools, which is not only illegal and against GBATemp's rules, but also breaks the NDA.
