I have currently been in the search for a 3ds xl with firmware 4.5 or below. I have done my research and know most info on what serial numbers are compatible. Today I found a new blue 3ds xl on ebay starting with sw1252. I got it for 200 which was a bit pricey since regular 3ds xl bundles are currently on sale for less. It's not bad either since it's so hard to find a <4.5 model new unless you wanna get raped by resellers. Also just wanted to make sure this: will my 3ds xl have 4.5 or lower?

Edit: the 3ds xl is NEW as in UNOPENED just in case you didn't catch it

Should've asked the seller to send you a photo with the version displayed, well Gateway used a 3DS XL to test their Gateway product so the possibilities of a 3DS XL carrying a firmware of 4.5 and lower are indeed possible, as for your 3DS XL I think only if the serial numbers match even so you don't know exactly unless you ask the seller to confirm it for you.

how long ago did you get that though? Also, the person I was bidding against was probably well aware that it would have <4.5. If not, he must be an idiot bidding in the 190s.

You take your chances really, the system could of been updated, most are unless its been untouched in its box since release. You should of asked for System Firmware info before buying, you could end up being major gutted! Ebay of all places as well :( and I presume its a second hand buy of someone?. You need to ask the seller before handing over your hard earned cash, even though its says new, new on sites like Ebay does not always mean brand new never touched!!!.

The seller has a high rating and the pictures have the seals still on the box
While most likely safe if the seller has a high feedback rating and has multiple great seller feedbacks, it is very possible to get seals off without disrupting the packaging. It can be done if manipulated very carefully. Hopefully, you will not find out about this firsthand. The reason why people are quite cynical on this issue is because there have been complaints in the past about similar issues.

I guess I'm going to just have to wait and see. I will just return it if it was opened before.

If the seals are still intact and the seller has pics to prove it, you are going to be hard pressed to prove that it was opened. Since there is no pic showing the firmware or no communication stating that, there isn't really any way for you to use firmware version as the basis of a return dispute if the seller decides to stonewall. That's why everybody was saying get proof of firmware version. There have been instances of firmware 5.x and above on units lower than the upper limit on the wiki. They are sporadic, but it can happen. I believe the lowest incidence was reported was a blue/black in the range of 1230xx (it's listed in the wiki.)

Here's hoping that all goes well.

Yes, I received a 3DS with 2012 on the box but it turned out to be firmware 6.2.
However if the box is not opened and serial number is stated, it shouldn't be a problem.

Either January or February. Seller still had some in stock, and I even tried posting on here to get people to buy them. No one did, and the seller had the same amount in stock after a week. They're probably gone now, since $165 was pretty cheap for a 4.1-4.5 or non-4.1-4.5.

EDIT: The seller still has some in stock, color: red, serials at or below "SW1195"!

$180 though...

The seller has pretty much no say when it comes to an ebay dispute. If the buyer says something is wrong or not as described, then 99.9% of the time he will get his refund, no matter what sort of proof the seller has.
