It's not the "first" game not working as there are a few games that need this type of patching.

No it isn't because this isn't a retail game find one retail 3DS game that doesn't work on the gateway and then the OP's claim is correct other than that the title is misleading.

When I read the title I was like oh crap now new 3DS games aren't working!!! it gave me quite a scare
