Frederick Smith of Aurora, Colorado has a medical marijuana card for pain he suffers resulting from a bike accident. Last Friday night, after a long day at work, Smith ordered a pizza. While his nine-year-old daughter was upstairs taking a bath, Smith smoked a quick bowl. Pizza delivery guy shows up, drops off the pie, and leaves.

Shortly thereafter, Smith tells Westword, he heard loud pounding on his door. He opened it to find an Aurora Police officer; he explains he'd been called by a Papa John's driver who said there were small children around marijuana, and (per policy) came to check on the situation.

9News reports the officer searched the house and left without filing any charges. In the meantime, Smith has complained to Papa Johns and the Better Business Bureau.

The pizza delivery man says he contacted police to double-check on the welfare of the 9-year-old child, according to 7News.

In a statement, Papa John's defended their driver: "He was acting as a concerned citizen and for what he believes was the best interests of our community."

Nothing bad about the article at all. He smoked for medical reasons and the delivery man was just reporting due to concerns he has. I was expecting some kind of dumb story.

Yea, prominently in CA I believe. There's literally 10 medical marijuana shops in a 3 mile range here.

Maybe not should I ever meet them a headbutt will probably happen but I still file this under dick move on the part of the pizza guy. Should the house have been hotboxed then maybe but otherwise a waste of time for all concerned.

Some points....
Firstly, in a state where medicinal marijuana is available, can't the police be allowed access to a list of who's allowed it to prevent wasting their own time?
Would the pizza delivery have called the cops for anything else? If the bloke opened the door with his cock hanging out in front of his kid?
If the child was in the bath, how did the Papa Johns guy see them? I'd be concerned that some creepy pizza dude is spying on my child through the bathroom window...

As I type this I am getting serious Deja-vu, I'm sure we've seen this article before (if Huffington post's attitudes to their reporters is the same in the US as the UK, they may well be forced to recycle old articles)

Although it did not appear to be the case here the federal government (which the DEA are part of) and state law can and frequently do disagree quite strongly on this one. It can create some interesting legal situations especially when the police (state or local) technically have to uphold both laws (it gets even worse when it comes to things like states rights but I do not care to spend too much time pondering the mess that is US law- in theory it is somewhat like EU law/legislation but in practice the federal government holds a lot more sway than the EU does to say nothing of jurisdictional matters and how it all folds into the grades of criminality (misdemeanour and felony and beyond).

Definitely on the pizza man's side with this. Even though there doesn't really seem to be any dispute.

As for the whole "medical marijuana" thing, from what I've heard, it's insanely easy for anyone to get a medical marijuana card, regardless of the severity of their injuries.

Also, I don't think the guy should've been getting high while his child was taking a bath, or even when they were awake. He could've done it when they were asleep, or when they were at school or whatever. He was most likely just trying to get high for enjoyment, rather than actual medical purposes.

I'll say I'm on the Pizza Guy's side, but what he did was a total dickmove to the guy. Can't blame him, though, he was only looking out for the kid. Though how did he know there was a kid in the house?
