Nintendo is requesting $4.5 million in damages from a Reddit moderator

Nintendo is going after more people who were involved in distributing Nintendo Switch warez and popularizing it on Reddit. A moderator, "Archbox", of the r/switchpiracy subreddit, is being sued by Nintendo for copyright infringement through distributing and hosting pirated Switch games. According to the court document, Nintendo attempted to reach out multiple times to the defendant, named James Williams, to get them to stop hosting "pirate shops" that would allow for seamless illegal game downloads from the Nintendo Switch console directly. Williams also requested user donations to help pay for the costs of hosting the illegal warez. Allegedly, after Nintendo reached out a final time with a cease and desist order, Williams stated a legal counsel would be in contact imminently, to which Nintendo claims never happened.

As a result, Nintendo is seeking $4.5 million dollars ($150,000 per infringement) from Williams in damages to their brand, as he was willfully breaking the law with "reckless abandon".

No, it really shouldn't. Companies need to stop treating piracy like it translates 1 to 1 to lost sales.
I’m saying that so it goes down. Piracy honestly should just be a loss factor in game development anyways. There’s always gonna be a bootlegger of movies, a copy printer of board games, and a downloader of video games. It wasn’t a sale they were going to get anyways; that person had no intent of buying a game.

TL;DR: No one will suspect a thing.
if the government wants to find it they can. if your not doing anything nefarious your isp wont care nor will any of the hubs internet traffic routes through before it gets to its destination. when people think of encryptions they think they stop everyone from accessing and your real time decrpytion with consumer hardware and software is somehow unable to be decrypted in real time by anything but that software and hardware.

logs are logs and unless ur doing something that lawyers start sniffing you out it doesnt matter but if you are doing something and lawyers sniff you out in America good luck with whatever ur doing to try to hide urself.

What most people are doing with encryption etc is just trying to hide from corporations and criminals that dont have the utilities and capabilities the government does.

no one seems to learn anything from edward snowden and people are going to refute any type of claims that encrpytions arent safe and that government can see everything ur doing.

So its hard to respect anything they do even when they are right because they are literally bullies and no one wants to support that behavior.
Honestly, even Gabe Newell and Sony bend the knee to the U.S. government regardless of who's in charge, because large businesses would rather stay on the government's good side than do anything that could risk years of work building powerful businesses and conglomerates being undone in a fortnight. Biggest evidence of this being the DEI initiatives: practically every U.S.-based game developer/publisher was very gung ho about them, even in the face of consumer backlash and lower sales, right up until U.S. leadership changed and DEI initiatives suddenly weren't popular anymore (read: they couldn't get any extra funding that would cover the lost sales). Or the whole Visa/Mastercard thing which is slowing building up.

Are you going to continue respecting companies like Valve, Sony, and such? After they all wimped out like Wimpods in the face of pressure from the government and banks?

(Don't really like talking about anything politics-related in a non-political section, but if politics is being dragged into the conversation anyway, might as well set the record straight.)

I used to prefer SONY over M$ and Nintendo but i gave up on console after the PS3 and only play PC now (SEGA was my go to but they stopped making consoles a long time ago lol).
As for Valve, i only use them if i have no other choice, i always try to buy games directly from the devs directly so they get 100% of my money.
But yeah, the whole gaming landscape is a mess nowadays . . . Lets not get into P2W garbage and mobile trash coz then we would just add more wood to the fire lol

There are better ways to prevent piracy than suing people into submission, especially people who don't own and never made several million off of this.

It should've been a couple hundred thousand, at most.

A few of you people hang around the politics forum, claiming to be on the left and against rich billionaires and corporations controlling what's right and what's fair. Yet here you are licking their boots because this one happens to make Pokémon. You make me sick.

The guy was making money from GAMES he didn't have the right to distribute! He did not own the property to profit from it...get it?

There is nothing political about his stupidity. Having an opinion on what the penalty or fine should be is debatable but blaming Nintendo for protecting their products is simply evil.

You see how this nonsense spirals out of control when so many have no common sense, think their entitled with no self respect, or to others.

Responsibility is the key here. The guy should face consequences for his poor judgement and terrible pirating practices.

So suing someone for millions, when Nintendo makes hundreds of times in a day more than what the guy made in his "career", isn't evil. But pointing out that being so ridiculously trigger-happy with your lawsuits when no other company is like this and there are many, MANY more progressive ways of fighting piracy, isn't. You have an extremely fucking warped idea of which offenses are more evil than others.

And yes, it is VERY political. The fact that you think this was deserved is caused by decades of corporate propaganda convincing you that this lawsuit is justified and the demanded amount is fair. Corporate propaganda that has seeped its way into our government, laws, and societal standards.

This is by far the most common myth. Piracy is not theft because it does not cause any direct damage or loss to the other party (in fact, whether there's another party at all is sometimes up for debate). Theft, on the other hand, is a criminal act because in committing an act of theft, you deprive somebody of something. If I go and take an old lady's purse, then due to my actions the old lady has been caused a loss, her purse. However, when pirating, nobody loses anything. The pirater gains a copy of some digital item, while the person/entity who originally created that item is completely unaffected by the act.

Honestly, I've got nothing to say for that first line besides: "PotAto, po-copyright infringement". Doesn't really matter as far as things concerning piracy once money changes hands at any point. The moment a pirate profits financially from their ill-gotten gains and gets caught doing so, semantics go out the window.

As for your second line, you can thank a little invention that God King Gabe Newell gave his blessing to before gifting it to the Steam Kingdom called "Denuvo Anti-Temper". Piracy of Steam games is unpopular now, only because recent iterations of Denuvo have gone uncracked for quite a while, or took months or even years to be cracked (everyone that was doing the cracking were either arrested, fled, or self-centered jerks who only did it if it was something they wanted to crack and people paid their extortionist fees). So pirates can't get their fix as easily as they could before Denuvo gained supremacy among DRM. And PC/Steam piracy can't exactly get a lot of online discussion when all the pirates (and people on older systems) are too busy whining about yet another game having Denuvo to consider just...finding something else to pirate.

I could case less what site staff pinned from the internet. I'm willing to bet not all have the same idea but a mutual understanding on where piracy stands in the grand scheme of all things relevant to theft.

I have not used Steam for at least 10 years now, and have no interest in broken digital gaming.

It doesn't sound like you support any business, big or indie, just as long as you get it free.

I think everyone knows where the real problems lie with piracy, who is doing it and why. Until people like you take accountability for being dirtbags and promoting the propaganda, dumbshits like this guy will continue getting made an example.
