Smash Melee modder takes a stab at Nintendo's litigious tactics adding a C&D Letter as a custom Melee character

Nintendo is well known in the modding and hacking communities for being one of, if not the most, litigious gaming companies in the industry when it comes to fan-created content, with their frequent legal actions against non-profit fan projects always being a point of contention with many gamers and modders alike.

This doesn't stop some people from peeking fun at Nintendo's actions though, as Super Smash Bros. Melee modder Moosh decided to have some fun with Nintendo's legalities and decided to make Nintendo's well-known Cease and Desist letter into a newcomer character for Smash Melee:

C&D Letter joins the brawl, being just an A4-sized letter with a default layout with some Nintendo information, paired together with a couple of detached hands and feet. The small teaser that Moosh uploaded to his X account showcases C&D Letter on the Pokemon Stadium stage, duking it out against none other than Fox McCloud, receiving quite the beat down before C&D comes back down and send Fox out of the stage. It also seems like the C&D Letter character was a mod done of Jigglypuff itself.

The letter in the character's body containts the following text:

C&D Letter character said:

Mr. Mooshies

RE: Unauthorized Distribution of Nintendo Brand Assets

Dead Mr. Mooshies,
It has come to the attention of Nintendo that you have
illegally distributed copyrighted Nintendo assets for
financial gain through the use of the website Patreon. This
is a breach of the Nintendo consumer contract and we
ask that you immediately cease operations, or you will be
subsequently sued by Nintendo to the fullest extent of the
law. Low-key that mod do be sick af tho lmao, it's just that
big Shiggy will get mad at me if we don't send this out. You
know, legalities and all that crap.

Mooshies you have to stop. Your mods too though.
Your Game and Watch too different. Your bitch too bad.
We'll kill you.

Sincerely,

Doug Bowser
Nintendo of America CEO

The C&D Letter mod for Melee is of course all fun and giggles. Although, Moosh does make Smash Melee mod consistently, and his most recent one was a Balatro character, which he made available through early access through his Patreon account.

That is some... interesting language there.

Gotta say I had a good sensible chuckle seeing this.

Nintendo really needs to be bashed harder in the modding community, but few are willing to weather the C&D/DMCA routines they crap out on command. I don't care about IP nonsense - they're petty to a fault, and no amount of "we must protect our brand" bullshit will make me think otherwise. They've even gone after free games with no cash attached to them.

They're the only company that does that too, possibly because video game IPs are their sole source of income (the games themselves, rights to them, merchandising, etc) while the other two out of the Big Three have other avenues for income.

The fact a clone character that just so happens to use a mock DMCA paper with very little added on top really is front page news shows some really low standards in the vetting process.

Also:
...which he made available through early access through his Patreon account.
So he's taken a bunch of lobotomies and is begging Nintendo to DMCA him with Patreon early access. I hope it happens and every time someone complains, someone brings that up.
