I missed that entirely despite usually seeing most such things that go on in ROM hack world. Got any good coverage of that?

Anyway trademark law says they have to so I basically can't get upset as it seems pointless.

@FAST6191 I made a mistake. As far as I can tell, no ROM hacks got nuked, only a couple of YouTube channels playing ROM hacks. Will change tomorrow. (No access to PC right now.)

Doesn't matter whether or not they frequently get nuked-- the fact of the matter is that it's in the DCMA that the copyright has to be protected or the risk of losing it ensues.

It is more trademarks that you have to enforce and genericide has been a thing far longer than the DMCA has been around. There is even quite an amusing case in Nintendo's earlier (as far as this games lark goes anyway) history http://thegaminghistorian.com/universal-vs-nintendo-case/ (Universal City Studios, Inc. v. Nintendo Co., Ltd. if you have better means). There are some instances of copyright not being enforced (ish) and it coming back to bite people, fan works being one of them if a similar story is made (hence things like the Microsoft usage guidelines saying you hand over all rights to the story in your fan animation), but the trademarks are the big one.

That said it seems to be a good way to get people to mirror and discuss and distribute your works.
