Merely using CFW is unlikely to get one banned. What matters is what you're doing with your CFW.

That all depends on what you do. If you install pirated NSP files, for example, there's a very good chance you will be banned if you connect to the internet without 90DNS and/or Incognito.

I did 2 of them I even tried to play online with pirated games[It didnt let me]

You will likely be banned at some point if you connected to the internet (without 90DNS or Incognito) any time after you installed a pirated NSP file. It often takes awhile before the ban actually happens. You're likely just flagged to be banned during the next wave.

3DS ban are HARD to happen nowadays.
I play Mario Kart 7 online every day since the year started and i havent been banned.
And yes, i installed using a CIA.

Don't get too cocky mate.
You never know when Nintendo decides to swing their banhammer.
I used to act and think like that too until I got kicked off the online service eventually.
Set up hekate/atmosphere whilst still in their early days of development summer's last year, played online installed pirated nsps and such and surprisingly I didn't get a ban until much later and ended up getting banned for good in November.
Now I have no Ill will against you and in no way whatsoever do I wish for you to get banned or whatever but don't get too carefree because you never know when they do decide to ban you.

Honestly, I just stopped caring about it now

I have 2 (one is 1.0.0 unit and pretty much never used) switches and it was just annoying for me to constantly enable/disable wifi for simple stuff (so on my main switch, 8.1.0 now, I was always online without any DNS). Now I am literally just waiting for ninty to ban me. But it takes them quite some time (idk when NSP installation become possible).
Luckily I didn't need to touch my second 1.0.0 switch yet.

I couldn't care less about getting banned from online services so myself.
I don't play online local multiplayer with a few friends is my thing.
Lucky you to have a second switch on 1.0.0. Think of all the possibilities such low firmware offers.
I don't have a clue either as to why it takes longer for some and less for others to get banned. Either depends on what they do/how they use their switch, or Nintendo merely takes pity on some and "forgives" them.
