i was watching a video on this. game looks really fun. I am on 4.1 right now, i do not have the game. If i was able to buy it, and then the new firmware came out, am i able to still play if i don't want to update? I know it requires a network connection. I am just unsure if it requires an online connection or not.

I'm not sure what game you're talking about, but if it requires a stable internet connection to play, you're not going to get that with an out of date Switch. you need to be on the latest to access online functionality.
