As per @x0b3chn the GameStop store near him (USA) is now stocking consoles with firmware 3.0.1. So be weary when purchasing at GameStop if you're looking for a console with firmware 3.0.0 or below.

If you got it from walmart you can open it and power it on to check the firmware. You wont have any issues returning it.
