exactly my thoughts too, rly curious about this one..Ofc, with regards to the main topic here, going online outside the pirated game (i.e going to eshop, or making a system update, and such) is still debatable if it's safe or not.
Then the guy can claim he didn't backup anything and blame the buyer.You must have misunderstood me. Nintendo won't unban either of these guys. But the pirate will probably get in trouble with GameStop for selling a game which he backuped before.

nice, so you think it would be safe to update fw/fiddle with the eshop etc.i doubt it unless you go online, anytime you insert a cart it adds a game icon. Unless that game icon itself stores the "cert" i dont see any reason how the could tell

I thought the guys from atmosphere were anti-pirate and more homebrew oriented. If thats the case they wont be the one making your future option for pirating gamesthis is why im waiting on atmosphere cfw, the guy knows the ins and out of security (obviously he didnt know about transplanting entire games with his layeredfs) that itll probably be the most safe of the unsafe methods of gaining full control of the device.

There is absolutely no reason why someone who hasn't paid for their games should be able to use Nintendo's online resources.

funny thing is, i dont even play 90% of the games i pirate ._.pirating games is meh. i generally buy the games im interested in.
