Gaming JAP. PKMN moon safe to use on US 3ds with cfw?

I have a spare 3ds and I don't use it much and was wondering if I put CFW on it:

could I play Japanese PKMN moon on it (to get the japanese only event pokemon legitly to send to my NA pokemon Sun)?

if yes:
Would it be safe to?
would it likely get banned? (i do have some games I only use it for so that would be undesirable if the case)

The events count your game region and DS region when looking for a gift. You need to use region/language emulation through LUMA or NTR to be able to receive the Japanese pokemon on your US console. Or you can use a program like mystery machine to patch it on the fly but your pokemon will end up with mismatched sub regions, regardless of the method you use. Example, if you're in the US and you change the region/lang. to JPN then receive the pokemon. His data will be Lang. JPN, Region. JPN, 3DS Region, USA.

The only way to fix it is with PKHeX. Although you can't even see the 3DS region in game so unless someone can check it PKHeX themselves it won't matter.
