Again, there are other variables at play, but generally speaking, turning off the "send information" Spotpass setting gives one an 86.2% chance of not being banned, according to the poll. This poll doesn't take into account other variables, such as the Friend List setting. It's possible many of the 13.8% of people who had the "send information" setting off but still got banned also had the Friend List "show what I'm playing" setting on. We also know that a lot of people in that 13.8% were mistaken and actually did have the setting turned on.

I have my money on the use of eshop

Most go to it either to get legit stuff or for other minor things, but that + CFW and having games installed is a more dangerous cocktail

Just a quick observation, but I've noticed that it seems like people that have changed their SecureInfo_A file have not been banned. Then again, they might also be like me and have all the sharing stuff off...

Ugh, decided to check on a N3DS that was abandoned as a backup, got on the ban wave, had spotpass and share info off

Last time playing online was with a Sm4sh cartridge, it has cias and freeshop games, never used on new or unreleased games

Do we already know if ban is still temp?

Trying to play MH Gen cart online and it's telling me to update the system, which I don't remember it doing before. Same message when I try to access friend list. Any idea if that's just an update nag, or likely ban? Luma 6.6 still, never updated to 7.

I believe you need to be on the latest fw to use access friend list.

What's the point of this? If you get banned, you can't go online anyway. By not going online you're just effectively banning yourself.

True but that's not the reason why I am afraid of getting banned. No. I am not just into online, thats all. If you really want to getting online. One options: Get other system (non cfw).

If you're not into online, what would you care? The only thing you would lose by being banned is something you don't use anyway. Seems to me like as if you were afraid of getting banned from a liquor store so you made sure to stay away from it, but you don't drink so you'd have no reason to want to go into the store anyway :-p

yes you loose something, i dont play online but this days almost all the games have extra content to download, like layton series, one of them have 365 more puzzles to download, monster hunter also have some extra missions and buddies to download and there is a long list. this is the only and most important thing to miss for me.[/QUOTE]

Damn.

My n3dsxl is still on 11.1 or 11.0 with a9lh no boot9 yet, don't remember haven't played for month. Played alot of SuMo online.
Haven't dare to check my status yet as the banwaves are ongoing right?

I know it's impossible to tell but might I've been lucky? How long should I wait and see in your opinion? I want to contribute with all details as possible to help the community ofcourse!

Go on ahead and check, just get online and check your friendlist, if you're banned you'll see an error right there

If you wanna feel safe about it, just check that you have turned off to show what you're playing on your friendlist options and turn off receiving and sending spotpass info on the 3DS settings before going online

It's not 100% safe but it's better than nothing at all

To anyone who say "I did this and i'm not banned" what you are really saying is "I have not been banned YET".

I believe the cause of most bans in the wave has been figured out. and it seems to be... running unauthorized CIAs while connected to the internet, regardless of piracy.

Sniffing has determined that the console ALWAYS reports to nintendo what CIA you are running if connected to the internet. if it's one that's not supposed to exist, or one you haven't bought that doesn't have an all console signature, they can catch it.

As for banning. there's one trick that requires cfw, is not piracy, and is harmless to nintendo.

NTR streaming+online play.

Because of how the bans are working, this is killed as near as I can tell.
