Always buy physical media folks. My second switch I had my hacked save on (though no CFW) and used the same Splatoon 3 cartridge with (that I ended up starting a new file over with a new Nintendo account) hasn't been hit. My main switch is fully gone now though.
I've been wrong plenty of times, but I would be a bit surprised if logging into your account on a second non-CFW Switch could cause a console ban on that switch too. Because if that happens, you could just go around adding your account to anyone's patched switch if they let you borrow it and get it perma banned from Splatoon simply by logging in. That seems like it could be a disaster if that's possible, plenty of unknowing people and families would share consoles.
So for those following:
- Used CFW on Switch-1 to edit with shivbot with Account-A
- Account-A got perma-banned from Splatoon after 1.3 update, all other online worked
- New Account-B started on same Switch-1 (original FW + legit Splat2 save)
- Worked fine until rainmaker patch and then ban on Switch-1 changed to console ban, so I can no longer connect with Account-B or any services. Switch-1 appears to be bricked from online now.
- Plan is still to get a second switch-2 and try logging in with Account-B to keep playing because it would be weird if Account-B auto-bans a new console, that account has never had any kind of editing. That would mean anyone's switch can be screwed just by giving them Account-B login (which I wouldn't do, but that's the reason I think that it causing a new console ban would be dumb). Hoping this is the case.
Edited: corrected comment about online. After restarting console it's donezo, so I guess I have a fully offline switch-1 now.

I got banned from Nintendo. I edited money and chunks from my banned account. 
However, my account can play online games except for Splatoon 3. And I was able to access the eshop too. I created a 7-day trial account. This trial account was able to play all online games, including Splatoon 3.
I took a packet dump of my Wireless Router's outbound interface with Wireshark, and the peculiar thing is that if I kept online in Splatoon 3, in/out packets were generated in an unknown format once every 2 hours.
This packet only occurred in Splatoon 3, and packets in this format did not occur when playing other online games (Diablo 3, Monster Hunter Rise, Minecraft Dungeons).
I wanted to do an edit test after applying the Deny policy for this packet to the Wireless Router, but I know that many people get console bans, so I didn't try this.
I'm still grateful that my Nintendo Switch can play online normally, so I won't take the risk.

Used Shiverbot on 10/23 at 12:15 am and got account banned on the 25th. Edited chunks, cash, and tickets. My account was logged into a patched switch prior to the usage of Shiverbot and I have not been console banned on my cfw switch yet. I’m fully expecting it. Will update

very very small possibility that these bans are temporary but 99.99% chance they are permanent, you'll have to buy a new switch and make a new account to keep playing
Maybe 14-30 days, if more than 30 days I suggest you buy a new switch, or hack your switch

I know you have to create a health and health max variable. Then there is a calculation you use in code to subtract width size of the health bar. Google few vids.
