What about people who has the SpotPass disabled and still get banned or the people who has SpotPass Enable and didn't get banned?
Then they are either lucky, flagged, used save editors or installed out of region games. Thats what Im concluding it to be atleast.

I hope this helps. I have 6 3DS's, all with B9S installed. One of them I use as a ban slave so the info from this one is probably not helpful, but the following info might be:

New 3DS XL (Red)
Version: 11.4
Homebrew installed: Various, including Freeshop 3 and FBI injected into H&S
Status: Banned

New 3DS XL (White)
Version: 11.4
Homebrew installed: Luma updater and FBI injected into H&S. No Freeshop
Status: Not banned
Freeshop has previously been used on this console but deleted within 6 or so hours about 5 months ago and deleted from the title log

New 3DS (White)
Version: 11.4
Homebrew installed: Various, including Freeshop 3 and FBI injected into H&S
Status: Banned

O3DS XL (Blue)
Version: 10.7
Homebrew installed: Luma updater and FBI injected into H&S. No Freeshop
Status: Not banned
This was not setup with a friend code until this evening
Freeshop has previously been used on this console

O3DS (Red)
Version: 11.4
Homebrew installed: Luma updater, TWLoader and FBI injected into H&S. No Freeshop
Status: Not banned
This was not setup with a friend code until this evening
Freeshop has previously been used on this console

EDIT: On all consoles both spotpass and share which title I was playing was on

Freeshop is becoming a recurring theme alright...
Still not completely consistent though. I use Freeshop yet I haven't been banned. I did have the spotpass system sharing information turned off though, I haven't checked in ages so I did earlier and it was set to OFF despite stuff saying it resets when you update, so yay I guess?

This has probably already been said, but what if spotpass is required to be turned on, and something else has to be there for it to detect the ban? e.g. spotpass turned on and freeshop (just an example) installed, so banned. But one without the other, no. Just a though.

I have news from a latín american facebook group someone has make a Windows script that modifies the local friend seed_a automatically when you provide your original banned seed And it works but only on 3ds new 3ds dosen't work for some reason

The culprits are most likely any homebrews installed as CIA (or any title with a non legit title id)

Suppose that what you say is the true nature of the ban and are not yet flagged, which is the best way to delete FBI and all installed CIA removing the ticket that left behing ?

Could they see it with spotpass being off is the question though. Im not using an homebrew until this rolls over.. And If it doesnt, bye bye to my 3ds I guess.

It seems they get the title IDs of the things you launched, via spotpass. This makes it very easy to ban. They could either
1) compare the title ids with the bought ones (assuming they are able to tell if a title id belongs to a cart or not, and they probably can't)
2) have a whitelist. If any title ID isn't among officially released game/apps, in the whole world or in your region, obviously you modded the console
3) have a blacklist and check for specific titles (FBI, freeshop, etc.)
They also get the title ID of everything you launch if you enabled the "share currently played title" in the friends list. Which makes it also very likely

Most likely that's the gist of it. At this point, people just want to cut their losses and just access online again, even if they haven't been doing it for quite a while now. The thought of not being able just drives them crazy.
