The EULA does prohibit the use of modifications or any actions that allow unsigned code to be run, however this only gives Nintendo the right to disable modded consoles. This does not give them the right to take down videos on YouTube. Content on YouTube is not within Nintendo's legal jurisdiction, and them using the BAF to strong-arm YouTube into deleting videos certainly is overboard.

tubehax works by redirecting your 3ds connections to a specific dns, which would be considered tampering. o and later in the agreement it states you cant reditrect connections.
redirecting DNS has nothing to do with what you said. It isn't illegal to redirect DNS and isn't modifying in any way whatsoever.

no, its not illegal to redirect the dns, but its still in violation to alter the video playback function.

what does that have to do with tubehax again? Tubehax isn't violating the EULA. Redirecting DNS isn't illegal. Tubehax isn't homebrew. No they don't have any right to take down video's like that

I'm just wow So when is nintendo gonna stop this BS and just plain fix eshop so freeshop can't work taking down youtube vids is pointless if you can't read 3ds guide you shouldn't be messing with your 3ds anyways
Actually they can't. The way they made the eShop basically limited them right from the start.
Nintendo actually really bad at security.

Tubehax isn't altering hardware or software. It isn't homebrew. Redirecting DNS isn't illegal.
There literally isn't a single line in the EULA wich tells you that you can't redirect DNS.

EULA violation or not, can we all agree that the EULA only gives them jurisdiction over your console, and not over videos hosted on YouTube because they don't own YouTube?

Would that cover tutorials and videos that provide links to tools used to facilitate homebrew only, or any video that even remotely mentions modding without even providing instructions? I can understand the former, but the latter would be a stretch.

That happened. I guess if you string it along to the tune of, 'You stopped us from finishing inside you; we're breaking up.'

So you don't want to agree to the terms to agree by circumventing our ability to fck you--you broke our EULA.
If you don't agree you can't go online and use the E shop or online gameplay but it still doesn't say you're forced to update your system. So by that logic every system that isn't even connected to the internet is doing illegal stuff. No it doesn't work that way
