To clarify, at least for the United States, there is no "breaking the law". I cannot speak for the laws of other countries (like the UK, Canada, etc), but at least in the USA, you're not breaking any law, per say. Nintendo could in theory sue you for copyright infringement, but that's a civil matter. I could sue you because I don't like the color of your socks, for example.
Note that civil law in the USA is never "illegal" or "against the law"; something is "illegal" if it violates criminal law (think theft, murder, or so on). It simply means it is reasonable grounds to be sued for. That being said, Nintendo would be a complete fool to sue someone for it. The general amount you can be sued for personal copyright infringement of this kind would be around $5,000. It would cost Nintendo mountains more to track you down, send you a notice, hire a lawyer, and go through a rather lengthy courtroom process.

Nintendo can't really tie it back to you, just your IP, and IP's aren't people. CIAngel sends no identifying information to Nintendo's servers while downloading data.I suppose not, it just seems so much more risky downloading it on nintendo infrastructure that's all.

Sorry to bring up something so late but I have tried installing smash (it did install) but I don't have any of the DLC. Is there another CIA i need to download via CIAngel?I would argue that you don't really need to worry about downloading DLC for Smash from CIAngel. The reason being is that the CIA out there to unlock it actually unlocks all DLC every time it's released. Every time you install the update, all available DLC is automatically unlocked. So you just need to install this single CIA once and that's it. The actual DLC is on the software update.
