You perhaps have opened the e-shop with the CIA installed?

I actually did. I followed the link to update within the smash bros cia and after updating through that I saw that I couldn't go online on smash or see my friends list.

Edit: Before that I did patch the CIA with a patch to get the DLC for free. I updated through the eshop right after that. Could that have gotten me banned?

I read in another discussion GBAtemp that when you enter the e-shop with the CIA had been banned.

Is it illegal? Considering they are spying to simply protect their rights and prevent unauthorised modifications and installations to their system. I'm all for the, "I purchased the device so I can do what I want for it" argument. Thats awesome for indie developers (who can't afford the expensive dev kits and licenses) and home-brew enthusiasts. But when its being used to steal illegal games, then no. I don't think its a problem to "spy".

thats just you whiteknighting and scaremongering
if that truly was the case we would never pirate anything and would purchase all as all device and software sellers would have free rights to watch our stuff

plenty of gophers in the playing field, to me if you have the balls to bring a CIA into the eshop that can be vetted by simple checking a purchase history and considering the downtime nintendo put inplace to test vetting the accuracy of false positives then it could be a possibility banned consoles could flood the market.
Yeah, it might be..

The "I bought it, so I can do what I want with it" argument doesn't work. Essentially, you're paying for the right to use the equipment; you actually don't own it. Owning it would imply that you own the copyright, and that's not the case. Welcome to legal jargon.

Ok, so I called them just to see what they said. Basically, the bans are not permanent, but they won't for the life of me tell me exactly why I was banned.

But, they also indirectly basically told me that I was banned for playing a couple games illegally. So I threw out a random title and the rep was all like "Yeah, it was that one! It's not linked to the NNID on the console." Only the random game (Smash Bros) wasn't on MY 3ds while I have had it. So they can see what games the currently signed NNID has, but can't see what games otherwise. So I was almost for sure banned due to the previous owner's flashcard (a sky3ds+). Just have to wait it out I guess.

It's a well know fact that if you take a sky3ds online without a private header you WILL get banned. I'm shocked that .CIA games are still safe though.

I messaged the previous owner and he told me he used a private header. Do I believe him or not.

hmmm good question. I saw that you went to the eshop with an un-owned cia. Could Nintendo be comparing the cia you are updating to your purchase history? I'm not sure nor have I ever heard of this. I would not believe him until others start to experience the same thing. Maybe he cheated online? for example pokemon.
