ROM Hack Zelda BOTW bundle comes with unpatched Switch?

Does the Switch BOTW Zelda bundle gives me a higher chance of getting an unpatched Switch? Since they were released before the patched units?

Yea you have to rely on serial #, bundled with Breath of the Wild doesn't mean it is unpatched, you would have to look for the serial # or switch at a much lower firmware to be 100% sure it is unpatched.
