No problem for me here in austria, but i can imagine that it´s not THAT easy because lets say for example you logg in with an US ip to an US Nintendo server it doesn´t matter if you´re using an EU or Asia account etc you are in the US so their laws apply.
When i travel to amerika they are allowed to take my personal infos, fingerprints, etc so i believe GDPR really only applies if you are "physical" in the EU. But don´t quote me on that just spitting out some thoughts :)
Oh yeah the law only apply to EU countries by all means. But I don't think Nintendo's account service is that advanced that it's IP based. But to be fair, who knows? Would be odd however if you are on vacation in the US and they would spy on you while you where there. Because then they would be needed to remove your info once you got home since you opt-out to begin with.

This gets asked like every week. This simple answer is NO. Whether its nsp or xci piracy+online = ban. You can discuss about getting suitable certs, but in the end you are logging into their server under CFW mode. Sure you can update xci from horizon like normal via sysnand (non cfw mode), but that's about it in terms of "safe"

No one´s talking about piracy in this thread.

That´s exactly what we´re doing here, no one´s telling that this is "safe" or "unbannable" or smth like that, we´re just discussing theories and personal experiences what´s the problem with that?

It would be awesome though if we got programmable/disposable gamecards then we could have backups of our backups?

The problem is that regardless you insert a legitimate cert or not you are in CFW mode to launch the said xci. Its make everything pointless b/c your firmware alone will be detected if the cert somehow doesn't get you banned. people get banned just by updating their games in CFW using horizon.

1. If you own your title in retail format and you dump it correctly and use that title with the original certificate I would honestly say you would never get banned. If you sell/pass that retail title on your chances of a ban is then very possible, it will happen eventually.

2. If you share your own personal retail title card 1 & 2 certificates with other xci dumps, it’s a 50/50 chance of a ban, it probably would never happen but there is always a small possibility. Again if you sell/pass that retail title on your using as your donor certificates your chances of a ban will be a lot higher and it’s very possible, it will happen eventually.

3. If you use certificates you share with lots of other people or don’t even own the original retail cartridge or know where the certificate is sourced from but your using it anyway you will 100% get a ban.

4. If you never use a certificate on an xci dump you will 100% get a ban.

I would standby those xci dumped online rules.
