Matters to me not so much. I have no plans playing free games. It's probably just a network banned. OTT to disable something you paid for. Every bloody company out there can't tell the difference between pirates and the homebrew community x_x

They can only disable it if they know that it has illegal scheisse on it, people who don't connect it to the internet will be fine.
Plus I'm sure some clever person out there will be able to bypass all that stuff.

you don't get it do you? the 3DS can auto update on it's own without your permission! now it can brick your console without your permission too, you have no rights or say in this at all, i call this pure vandalism and lawsuits will get involved with this.

This is just a scare tactic, Nintendo won't shut down your 3DS entirely, they are smarter than that, and even if they did this could just be for Japan only. Doing this anywhere outside of Asia will lead to lawsuits.

+1 hehe let them try

If this does happen, it won't brick it. There's no way they would do that without expecting mass lawsuits.

Now, a plausible thing they could do is prevent game play or launching apps and whatnot. Of course, they'll most likely have someway to re-activate your privileges.

(Antoligy, if you read this, yes, I pretty much put everything you said on IRC into my own words. XD)

That would be the worst lawsuit ever...
"Nintendo bricked my 3DS!" - You
"Well, he stole games using an illegal flashcart". - Nintendo

Also, if Nintendo says they're gonna brick the 3DS, they probably will(unless a bluff). They know the laws better than any of us do.

Nintendo CANNOT "BRICK" anything legally!
Just like XBOX they can BAN you from something i.e. online play etc. but they would be up for a BIG lawsuit if they just stopped the console from functioning!

due to the fact that there is the chance of a False Positive.

Yes, because the console can automatically receive updates over wi-fi if it's NOT FREAKING CONNECTED TO THE INTERNET.

It's been said before, it's against laws in multiple countries. If Nintendo decide to go through with this, they can expect huge fines.

And so can we... We're the ones using flashcarts.

So people still believe rumours of illegal forced auto updates as well? Because it's happened everywhere so far. FFS they can't/won't even do that in any OS, where it would be a great idea to turn it on by default and only offer an opt-out. You have to opt in everywhere so far and I can't really see that changing.

Wait, wouldn't nintendo get sued over this? This sound like what microsoft did to banned people once, when they crippled the hd.

And it can even do it when it's NOT FREAKING POWERED ON!!!!!!!

Before anyone says anything, I am not against hacking the 3DS, I am against hacking the 3DS this early.
I have nothing against DS mode hacking. Early 3DS mode will be a blow but we've had DS piracy for years. having it on the 3DS makes no difference to devs.

you still don't get it, you can't turn off the wifi 3DS it's always on, as soon as you go outside near a wifi hotspot it will update!

+1 the only way you will stop the 3DS from updating it'self is if you rip out the wifi device from the console itself.

Yes, no...every electronic wireless device must/will have aeroplane mode, my wise guess would be the wireless commuication switch located on the side. You slide that down and there will be no local/WiFi commuications taking place whatsoever.
