Hacking R4s and bans

A friend used to use my 3ds to use his r4 flashcart (im not endorsing piracy) and he attempted to play online. Of course, he couldn't because WFC servers had already shut down. However, is it possible that nintendo logged his connection attempt and could theoretically see that the game he was trying to connect with didnt match the game in the system´s activity log? I know they probably wouldnt do this but I thought perhaps it could be at their interest if they ever released ds virtual console for 3ds. Thanks!

3ds is practically dead no more new VC will be released for a new VC not even ds VC and no Nintendo gave up on flashcarts back in 7.x fw when ds was dead
 
Absolutely not. Nintendo WFC servers for DS games have been shut down for years, and at this point the only thing that happens when you try to connect is that message that says the service has ended. Wouldn't really be worth the effort since the DS is well past end-of-life and the 3DS is about to be end-of-life pretty soon, if not already.

This problem has been circumvented to a large degree after the discovery of a gaping security flaw in the implementation of WFC. All you really need to do is specify a new DNS – and find people to actually play with, of course.

I don't know what you mean exactly, but any such major release at this point is vastly unlikely.
