It's always safest to be on OFW when accessing the e-shop. Stock=1 *should* still safe, because no sysmodules or patches are loaded, but not many people would put themselves on the line by telling you that. sys CFW, is a huge danger zone. Technically it is safe as long as you NEVER install an NSP, and NEVER run game mods or cheats online. But people like to play with things on emummc... and modules and cheats don't discriminate between emummc and sys. You can inadvertently go online in sys cfw with some sort of sysmodule that gets detected, or even a cheat for a game that you happen to play on emummc as well (something like a 60fps cheat on an online team fps can be detected, among other things). With that said, you can setup your dnsmitm to be active ONLY in emummc, so that you can access the eshop in sys even while in cfw mode... and you'd be safe, as long as all of the above remain true (no mods, cheats, installed nsp, sysmodules, etc,). SciresM has used CFW on sys since the very beginning (and before, considering he created Atmosphere in the first place), and his console has never been banned. It's just simply not a good idea. My original V1 switch was not banned for years... then one day after a firmware upgrade, I lost track of where I was and what I was doing, and opened up the tinfoil installer while in sys. That console is now banned because of that. If you use OFW only, you cannot make a mistake. The only thing you should ever do with CFW in sys, is backup game saves with jksv or whatever, and dump games/updates/dlc to install in your emummc. Running an NRO homebrew while in sys cfw will not get you banned (unless it's something like tinfoil, that installs itself to the home screen, or a forwarder for homebrew).
The only link I've been able to find for my version is here:
https://gbatemp.net/threads/release-hyrule-warriors-legends-save-editor-ntr-plugin.411349/
the US/EUR version, but the link is dead.
