I'm looking to purchase a ds was wondering which is easier to mod out of the 2 and which are firmwares to stay away from?

If you mean freeshop then no. That hasn't worked in a long time and never will again.

So there is no way to play ds games? What about through emulation or downloading the games to a SD card and etc?

freeShop has nothing to do with that. It simply allowed you to get lots of titles straight from Nintendo's CDN.

Yes you Install cfw using the guide I linked to. You then download 3ds games as cia files from the Internet the you use FBI to install them. Then you play them.
