I understand why some people maybe concerned and I agree that some of the scenario's posted here could happen. But in reality it'll probably lead to nothing.
Glad they settled instead of going to court. A judgement in court could have ruined the whole emulation scene.
Was always going to happen though, Nintendo wouldn't sit by whilst somebody earns $25,000 monthly helping people pirate their games. And yes, not everybody pirated, but lets say 80%...
Everything you are saying is speculation. It's a possibility. But as others have said, there are no examples. Nothing is proven. The video is clickbate. Currently nobody knows for sure what will happen if/when Nintendo take action
Once you've got the game showing on your home screen you can just download the update directly from Nintendo like you would any game which you own. It only lowers the value for preservation, but anybody who cares about preservation would likely be using a V1 or chipped Switch anyway
Whenever I pirate something I end up buying it if I enjoyed it. If I didn't enjoy it I'll delete my pirated copy as no point keeping something I don't enjoy. Piracy for me is basically a way to demo a game before I spend my money. I like owning physical copies of console games I enjoy. On PC...

You're probably better off posting in the big Instinct NX thread. I imagine a lot of the people who've been installing the Instinct will have it followed so your problem will likely get more attention

I was in the same position as you... Have an OG switch happily softmodded and decided to buy an OLED.
In the end the only way forward was to also mod the OLED, it made it easier to decide what to buy and what not to buy :D
The only problem is, I don't think my OG switch will ever be used...
