They did make their own implementation of it. I don't see the issue here.

No, they pretty much copied open source tools (looking at their implementation there's a lot of potential GPL violations that need to be reversed). Even if they had made their own "implementation" it would still be a9lh, which they did *not* discover and have no right to claim is their own.
