It takes a lot longer than a month for hardware to be manufactured and make it to western shores. Even a cart wouldn't be 10.4+. Mark this post and see when I'm proven right.

my AC:HHD 3DS came with 9.8, when 10.1 or 10.2 was out at the time. I got it launch day. some people say theirs came with 9.5 or so. that might give you a hint as to what FW this bundle will come with.
