    I ended up installing starfall and turing off the disc check and booting the pink fish disc. Then using the delete all option which fixed the menu. I then updated through Nintendo to get 4.0. Thanks all for the help.

    I've updated all the IOSs to 3.2 and I still have the problem. I also tried running Animal Crossing and it just boots it does not want to update under 3.2 maintenance mode.
