Well it's there but it could either be corrupted, or your DS isn't reading your SD card. Redownload the file and replace it, then check your SD card for bad sectors.

ok so replaced file and checked for bad sectors but none found. and its still not working

And everything worked fine before? Not really sure then, unless it's hardware related. Maybe someone else will be able to offer some additional advice.

yeah everything worked fine before i started to try and update to boot9

Holding Select doesn't help?
