Do you really think most normal end-users will remember if a homebrew once crashed for them? Then you have never read https://gbatemp.net/threads/nintendo-switch-banning-hub-warning.508710/ . Plenty of people who have been banned using legit XCI. Take a look.
No. https://gbatemp.net/threads/nintendo-switch-banning-hub-warning.508710/ look at the info. People have been banned for simply using their own private cert with their XCI. No crashes, no libnx errors.
They also probably didn't include the creport nso from atmosphere in sxos to reduce the ban risk.
BTW there was a bug in fsmitm (which is also included in sxos) that caused crashes after some time of usage, and if I remember it correctly, they also created an error logs and most people probably had this crash happen to them at least once.
The recommendation to clear error logs on firmware 5.x and above was still there a long time after SciresM found out about the possibility of Nintendo detecting this, so maybe some people did this and got banned.
