1. Yep, use JKSM, it's available as a .cia. Back them up, copy the folder it makes to the other console's SD card, then import them.
2. Yep just copy and paste the files (assuming updated sysNAND).

Yes

When i leave the wifi switch on will the 3DS automatic download updates and install it?

It will download them automatically, but not install them. This isn't an issue as you can update to the latest firmware without problem
